dc.description.abstractLas nuevas tecnologías están cambiando la forma de entender el trabajo, no solo en cuanto que facilitan su realización sino que en muchos casos permiten realizar la prestación en cualquier momento, en cualquier lugar.Cada vez es más habitual que los trabajadores consulten el correo electrónico de la empresa o lean mensajes profesionales de WhatsApp durante el trayecto del autobús, tomando el café del desayuno o antes de irse a dormir. Estos tiempos, en principio, no forman parte de la jornada de trabajo, pero, ¿podrían en algún momento ser considerados como horas extraordinarias o como parte de la jornada?La tensión existente entre libertad y eficiencia empresarial frente a garantías y seguridad de los trabajadores se pone especialmente de manifiesto cuando se abordan las cuestiones relativas al control horario y su registro, en particular el registro de las horas extraordinarias, que ha sido objeto de pronunciamientos judiciales dispares unificados recientemente por el Tribunal Supremo en las Sentencias 246/2017 y 338/2017. En las siguientes líneas se comenta el cambio de criterio jurisprudencial y su incidencia en el control de la jornada y las horas extraordinarias con referencia particular a los trabajadores a distancia.es
dc.description.abstractThe new technologies are reshaping the way work is understood, not only because they make it easier, but also because they allow to perform at any time, anywhere.More and more often workers check their job mail or Whatsapp messages while riding the bus, taking a coffee break or before going to bed. Currently, that time does not count as working hours, but, would it eventually end up being regarded as overtime or even part of the workday?The tension between free enterprise and business efficiency on the one hand and workers’ guar-antees and safety on the other reveals itself specially when matters as working time control and register are tackled, in particular overtime, as recent Spanish Supreme Court rulings have unified scattered criteria on the subject. The following lines comment on this judicial shift and its impact on working time control and overtime with a special mention to remote workes
